These Terms explain the rules for using Beta Break, how access is granted, and what you can expect from the service.
These Terms are provided as a template and should be reviewed by legal counsel before use.
By accessing or using Beta Break (the “Service”), you agree to these Terms. If you do not agree, do not use the Service. These Terms form a legal agreement between you (or the organization you represent) and [LEGAL BUSINESS NAME] (“Beta Break,” “we,” “us,” “our”).
You must be at least 18 years old and have authority to bind your organization. You agree to provide accurate account information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for internal business operations, subject to these Terms. We reserve all rights not expressly granted.
You retain ownership of the data you enter into the Service (“Customer Content”). You grant us the right to process Customer Content solely to provide and improve the Service. Privacy-related details are described in the Privacy Policy. You are responsible for the accuracy, completeness, and legality of Customer Content, including any inspection records, checklists, or guidance you create or upload.
We strive to keep the Service available but do not guarantee uninterrupted access or error-free operation. We may change, suspend, or discontinue parts of the Service at any time, including features or integrations.
Beta Break provides software tools for recording inventory, inspections, and related operational information. Beta Break is not a compliance service, certification body, or safety authority, and we do not provide legal, regulatory, engineering, or safety advice. Checklists, templates, guidance text, intervals, and status labels are informational only and may be incomplete, outdated, or not applicable to your equipment or circumstances. You are solely responsible for (a) determining whether and how inspections are performed, (b) ensuring inspections are performed by qualified or competent persons as required, (c) following manufacturer documentation and applicable laws, regulations, and industry standards, and (d) making all decisions regarding equipment safety, serviceability, removal from service, and return to service. Use of the Service does not guarantee compliance or safe outcomes and must not be relied upon as the sole basis for safety-critical decisions.
[PLACEHOLDER: Describe pricing model, billing cycle, taxes, payment terms, and late payment handling. If billing is not enabled, state that fees are not currently charged and pricing may change with notice.]
The Service may rely on third-party providers (e.g., hosting, email). We are not responsible for third-party services, and their terms may apply. Links to third-party content are provided for convenience; we do not control or warrant third-party content.
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet any compliance requirements or that any outputs will be accurate, complete, or suitable for a particular compliance or safety purpose.
To the maximum extent permitted by law, Beta Break will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities. Our total liability for any claim will not exceed the amounts paid by you to Beta Break in the [PAST 12 MONTHS / OTHER PERIOD] preceding the event giving rise to the claim. These limitations apply even if we have been advised of the possibility of such damages.
You agree to indemnify and hold Beta Break harmless from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your Customer Content, or your violation of these Terms, including claims arising from your inspections or safety-related decisions.
We may suspend or terminate access to the Service if you breach these Terms, if required by law, or if necessary to protect the Service. You may stop using the Service at any time. Upon termination, your right to use the Service ends, and we may delete or retain data as described in the Privacy Policy.
These Terms are governed by the laws of [STATE/COUNTRY], without regard to conflict of law principles. Any disputes must be brought in the courts located in [COUNTY/STATE].
We may update these Terms from time to time. If we make material changes, we will provide notice by updating the “Last updated” date or through the Service. Continued use after changes indicates acceptance.
